1. Who We Are and How These Terms Work

These Terms of Service (“Terms”) govern your use of the From The Clouds Coffee online store, including any purchases you make through our website (the “Site”).

In these Terms:

  • “Company,” “we,” “us,” and “our” mean Cyber & Coffee LLC d/b/a From The Clouds Coffee, a Virginia limited liability company.

  • “You” and “your” mean the individual using the Site and/or purchasing our products.

By accessing or using the Site, or by purchasing something from us, you agree to be bound by these Terms and all policies referenced here (such as our Privacy Policy and Shipping/Refund Policy). If you do not agree, do not use the Site.

Our store is hosted on Shopify Inc. They provide the online e-commerce platform that allows us to sell our products to you.

When you place an order on the Site, it is an offer to purchase the products in your cart. We may accept, decline, or limit your order at our sole discretion, including if:

  • Products are unavailable or out of stock

  • We suspect fraud, abuse, or violation of these Terms

If we cancel or cannot fulfill your order after it has been placed, we will attempt to notify you and will refund any amount already charged for the canceled items.

Order Changes and Cancellations by You

Due to the perishable nature of roasted coffee, we typically begin processing orders quickly. If you need to change or cancel an order, contact us immediately at info@fromthecloudscoffee.com. We cannot guarantee changes or cancellations once roasting or fulfillment has started, but we will make a good-faith effort.


5. Pricing, Taxes, and Payment

  • We reserve the right to modify or discontinue products or adjust pricing at any time.

  • Applicable taxes and shipping costs will be added at checkout based on your location and selected shipping method.

By submitting payment information, you represent and warrant that:

  • You are authorized to use the payment method provided.

6. Shipping, Delivery, and Risk of Loss

Shipping options, estimated delivery times, and shipping fees are displayed at checkout and/or in our Shipping Policy.

  • Title and risk of loss transfer to you when we deliver the package to the carrier.

  • We are not responsible for delays caused by carriers, customs, incorrect addresses, or events beyond our control (e.g., weather, strikes, natural disasters).

7. Returns, Refunds, and Exchanges

Because coffee is a perishable product, we typically do not accept returns of opened coffee. However, we want you to enjoy your experience with us.

In general:

  • If there is an error with your order (wrong item, damaged product, etc.), contact us within 5 days of delivery with your order number and photos of the issue.

  • For non-coffee items (e.g., merchandise, brewing gear), return eligibility may differ and will be described in the Refund & Returns Policy.

  • Any refunds are issued to the original payment method when possible.

We reserve the right to refuse refunds or replacements if we reasonably suspect abuse of our policies.


8. Subscriptions and Recurring Orders (If Offered)

If you sign up for a coffee subscription or recurring order:

  • You authorize us (and our payment processor) to charge your selected payment method on a recurring basis (e.g., weekly, monthly) for the subscription price plus applicable taxes and shipping.

  • You can manage, pause, or cancel your subscription through your account or by contacting us within the timeframe specified in your subscription terms.

  • Changes or cancellations may not apply to orders already processed.

Subscription terms (including any discounts) will be clearly described at signup and may be updated for future billing cycles with prior notice.


9. Product Information, Freshness, and Allergens

We do our best to describe our products accurately, including tasting notes, origin details, roast levels, and images. However:

  • Coffee is an agricultural product; flavor notes and characteristics may vary between harvests and roasts.

  • Colors and appearances on your screen may differ from the actual product.

  • Tasting notes are descriptive, not ingredients.

If any product contains or may come into contact with known allergens, we will make reasonable efforts to disclose this. However, cross-contact can occur, and we cannot guarantee a completely allergen-free environment.

Coffee contains caffeine unless stated otherwise. By purchasing, you acknowledge responsibility for understanding your own sensitivity to caffeine and consulting a healthcare professional if needed.


10. Personal Use Only and Resale

Products purchased from our Site are intended for personal use or gifts, unless we have explicitly entered into a wholesale or resale arrangement with you in writing.

You agree not to resell our products without our prior written consent.


11. Promotions, Discounts, and Gift Cards

From time to time, we may offer:

  • Discount codes or coupons

  • Gift cards or store credits

Unless stated otherwise:

  • Promotions cannot be combined with other offers.
